3. AI-Generated Meal Plans and Recipes Are Suggestions Only

All meal plans, recipes, ingredient lists, preparation instructions, nutritional estimates (including calories, protein, carbohydrates, and fat), and ingredient-quality assessments produced by the Service are generated algorithmically by an artificial intelligence system. They are provided as general suggestions for informational and convenience purposes only.

AI-generated content can be incomplete, inaccurate, outdated, or simply wrong. The Service does not verify recipes, ingredient lists, or nutritional estimates against any authoritative food database, laboratory analysis, or human review before presenting them to you. Nutritional values are estimates and should not be relied on for medical, clinical, or precise dietary tracking purposes. Any flags, swaps, or "ingredient quality" notes the Service generates (for example, regarding seed oils, added sugars, or processed ingredients) are automated suggestions, not verified facts, and may be incomplete or inapplicable to a specific product you actually purchase.

You are solely responsible for evaluating whether any meal plan, recipe, or ingredient is appropriate for you before you shop for, prepare, cook, serve, or consume it.

4. Food Allergies, Intolerances, and Dietary Restrictions

The Service is not an allergen-detection tool and must never be relied upon as one. It does not reliably or comprehensively identify allergens, cross-contamination risk, or ingredients unsafe for any particular medical condition, and it may omit, mislabel, or fail to flag an ingredient that is dangerous to you or someone you are shopping or cooking for.

It is solely and entirely your responsibility — every time, for every meal plan, recipe, ingredient, and product — to:

• Independently review every ingredient in every recipe before shopping, preparing, or eating it;
• Read the actual packaging, ingredient label, and allergen statement on every physical product you purchase, including any product substituted by Kroger or any retailer, regardless of what the Service displayed;
• Confirm that no ingredient, substitute, or cross-contamination risk conflicts with any food allergy, intolerance, sensitivity, religious or ethical dietary restriction, or medical condition affecting you or anyone you are preparing food for; and
• Consult a physician, registered dietitian, or other qualified professional before making dietary decisions based on any information from the Service, particularly if you have a diagnosed allergy, intolerance, or medical condition affected by diet.

To the fullest extent permitted by law, we disclaim any and all liability for any allergic reaction, adverse reaction, illness, injury, or death arising from or related to any ingredient, recipe, meal plan, or product suggested, displayed, or purchased through the Service, whether or not the Service flagged, failed to flag, or incorrectly flagged that ingredient. This includes reactions caused by product substitutions, mislabeling, formulation changes, or cross-contamination that occur at the retailer, manufacturer, or in your own kitchen and are entirely outside our control.

6. Kroger and Other Third-Party Services

Provisions is not affiliated with, endorsed by, sponsored by, or otherwise officially connected with The Kroger Co. or any of its affiliates or subsidiaries. KROGER® and any related names, logos, and marks are trademarks of The Kroger Co. and are used here, where used at all, solely to describe the optional integration this Service offers — not to claim any partnership, endorsement, or sponsorship.

The Service integrates with Kroger and may integrate with other third-party retailers or services in the future. When you connect a Kroger account and use the Service to add items to a Kroger cart, that transaction, the resulting order, product selection, product substitution, pricing, availability, packaging, labeling, and fulfillment are governed entirely by Kroger's own terms of service and are performed solely by Kroger. We are not a party to that transaction, do not handle or inspect any physical product, and are not responsible for the accuracy of any product listing, label, or substitution made by Kroger or any other retailer. Authentication (Google) and email delivery (Resend) are likewise provided by third parties over whose systems, availability, and security practices we have no control.

Kroger integration — connecting your account, browsing Kroger product and pricing information, and adding items to your Kroger cart — is a feature available to subscribers on a paid plan described in Section 7; it is not available on the free tier. Any subscription fee is paid to us for access to Provisions's own features, including this integration; it is not a fee paid to, on behalf of, or for anything Kroger itself provides. You never pay us for the groceries you actually purchase — any amounts you're charged for products are charged by Kroger directly, through your own Kroger account, separately from and in addition to any subscription fee you pay us.

Product prices displayed in the Service are retrieved from Kroger periodically and may be cached for up to 24 hours; they are estimates for planning purposes only and are not a quote, offer, or guarantee of the price you will actually be charged. Prices, promotions, and availability can change at any time and are determined solely by Kroger at the time of your actual purchase.

7. Subscriptions and Fees

The Service offers a paid subscription plan ("Pro"), billed either monthly or annually at the price shown at checkout, and a separate one-time purchase to unlock a single generated plan. Both are processed by our payment processor, Stripe; we never see or store your full card number.

Billing and renewal. A Pro subscription automatically renews and is billed at the start of each new billing period (monthly or annually, matching the plan you chose) until you cancel. If your plan includes a free trial, you will not be charged during the trial; unless you cancel before the trial ends, it converts automatically into a paid subscription and you will be billed at that point.

Cancellation. You may cancel your subscription at any time from your account settings. Cancelling stops future renewals, but does not end your access immediately — your Pro access continues through the end of the billing period you've already paid for, and will not renew after that.

Refunds. All charges — subscription payments and one-time plan unlocks alike — are final and non-refundable, including for any unused portion of a billing period after you cancel, except where a refund is required by law. Cancelling stops future billing; it does not refund amounts already charged.

We reserve the right to change pricing or usage limits on a going-forward basis with reasonable notice; changes will not apply to a billing period you've already paid for.

10. Disclaimer of Warranties ("As Is")

THE SERVICE, INCLUDING ALL MEAL PLANS, RECIPES, NUTRITIONAL ESTIMATES, AND INGREDIENT INFORMATION, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY RECIPE, INGREDIENT LIST, ALLERGEN FLAG, OR NUTRITIONAL ESTIMATE IS ACCURATE, COMPLETE, CURRENT, OR SAFE FOR YOUR CONSUMPTION, AND WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR PERSONAL INJURY, ALLERGIC REACTION, ILLNESS, DEATH, LOST PROFITS, OR LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY MEAL PLAN, RECIPE, INGREDIENT, OR PRODUCT SUGGESTED OR PURCHASED THROUGH IT, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
